Before downloading any materials from this site, please read the following terms and conditions. Using materials available from this site means you have read and accept the following terms and conditions.

  1. General. By purchasing or licensing any photographs (“Images”) from us, you agree to comply with these terms and conditions. If you do not agree, you must refrain from using our Images.

  2. Fair use license. Fair use is a doctrine in United States copyright law that permits limited utilization of copyrighted material without necessitating explicit permission from the rights holders. This doctrine encompasses various activities, including commentary, criticism, news reporting, research, teaching, and scholarship. The fair use doctrine is determined through a four-factor balancing test, ensuring that the use of copyrighted material does not significantly harm the rights of the original creator. Section 107 of the Copyright Act of 1976 explicitly grants fair use for purposes such as criticism, comment, news reporting, teaching, scholarship, education, and research. You may, without obtaining prior written permission from Michael Murphy or any agents authorized to appear on Michael Murphy’s behalf, use materials publicly available on this site for the purpose of commentary, criticism, news reporting, research, teaching, scholarship, and other use permitted under the Copyright Act of 1976.

  3. Ownership and Copyright. All Images provided by Michael Murphy are the exclusive property of Michael Murphy and are protected under United States and international copyright laws. Licensing or purchasing an Image does not transfer ownership of copyright.

  4. Permitted Uses. You are granted a non-exclusive, non-transferable license to use the Images for the purposes explicitly agreed upon in writing at the time of purchase or licensing. Permitted uses include but are not limited to:

    • Personal use

    • Commercial use as specified in the licensing agreement

  5. Prohibited uses. You may not use the Images for any of the following purposes without prior written consent from Michael Murphy:

    • Resale or redistribution of the Images in any format

    • Altering or editing the Images in a way that violates copyright or moral rights

    • Using the Images for any illegal or defamatory purposes

    • Submitting the Images for inclusion in artificial intelligence (AI) or machine learning (ML) datasets, including training or developing large language models (LLMs), neural networks, or any similar technologies

  6. Digital Protection Measures. Unless permission is explicitly granted, you agree not to remove any embedded metadata, copyright notices, or watermarks from the Images. You must also take reasonable measures to prevent unauthorized use or distribution of the Images.
